Please join SFIPLA and its panelists Dan Werner (NERA Economic Consulting) and Paul Benson (Duff & Phelps) as we discuss some of the latest trends and issues in damages methodologies in patent and Lanham Act cases. The panel will focus on the current state of apportionment and foreign damages for patent infringement matters, false advertising under the Lanham Act, as well as discuss pros and cons of certain damages methodologies. Bring your questions and we’ll provide the lunch as we learn new ideas and/or revisit old ones.
PANELISTS:
Paul Benson
Paul is a Director at Duff & Phelps in the Disputes Consulting practice. He has almost 20 years of experience in advising clients and counsel on complex commercial disputes and intellectual property matters. His experience includes the evaluation and quantification of economic damages in matters involving patent infringement, copyright and trademark infringement, misappropriation of trade secrets, breach of contract, and financial investigations. Paul has been retained as a damages expert on numerous matters related to intellectual property and commercial disputes.
Paul received his B.B.A in finance from Baylor University and an M.A. in biblical studies from Luther Seminary. He is a Certified Fraud Examiner and a Certified Licensing Professional. Paul is the proud father of four kids and enjoys coaching youth sports, fly fishing, and reading action thrillers.
Daniel Werner
Dr. Werner is a CPA and Senior Consultant in NERA’s Intellectual Property Practice, where he provides economic, financial, and statistical analysis to support complex litigation. Dr. Werner regularly applies his expertise to matters involving economic damages and valuation, among other areas. He has also provided expert witness testimony, including in disputes over intellectual property and false advertising allegations.
Prior to joining NERA, Dr. Werner served as an economist at a boutique consulting firm in the San Francisco Bay Area, and analyzed financial data while working at a Big 4 accounting firm. Dr. Werner has also conducted empirical academic research in applied economics, presenting his work at several academic conferences and serving as a peer review referee for academic journal publications. Dr. Werner received his Ph.D. and M.S. degrees from the University of Maryland, College Park and received his B.A. from the University of California, Santa Barbara.
