Medical diagnostics and testing have never been more important to human health and safety. The dramatic shift to personalized healthcare, early disease detection and COVID related diagnostics has most biotechnology corporations scrambling to develop new medical diagnostics and meet an avalanche of demand. The commercialization of a diagnostic device or assay  is often a lengthy, multi-step process that requires significant investment in research, design, manufacturing, clinical trials and regulatory approval. In each stage of the product life-cycle, a company can protect and enforce intellectual property flowing from technical and functional attributes of the technology. Determining the appropriate form of intellectual property protection and implementing an internal IP assessment and enforcement policy will help biotechnology corporations maximize the competitive advantage of the innovation and return on investment.

Please join SFIPLA in welcoming our esteemed panelists, Gargi Talukder, Lian Huang and Sandra Wells for a discussion about patentability issues, alternate forms of IP protection and enforcement of IP in the medical diagnostics industry.

PANELISTS

Sandra Wells joined Cepheid as Chief IP Counsel in May of 2020. Before joining Cepheid Sandra was VP, Patents and Assistant GC at Vivus, Inc., from 2012 to 2020.  Prior to that she held various roles at Affymetrix, Inc. from 2002 to 2012, serving as VP and Chief IP Counsel from 2008 to 2012. Dr. Wells received her B.A. in Biology from Whitman College, her Ph.D. in Molecular Biology from U.C. Santa Cruz and completed postdoctoral studies in the department of Molecular and Cellular Biology at U.C. Berkeley where she was a Jane Coffin Childs Fellow. She received her J.D. from Santa Clara University School of Law and has been admitted to practice in California and before the U.S. Patent and Trademark Office.

Lian Huang is an Informatics Patent Counsel at Genentech. Prior to Genentech, she was at a patent boutique, where she specialized in strategic, holistic portfolio management and counseling for mature medical tech start-ups. Lian has been practicing for over 10 years. She received her JD from the University of Maryland and her B.S.E. in Biomedical Engineering from Duke University.

Moderator, Gargi Talukder is a partner at Orrick in San Francisco, where she helps life sciences companies with global patent portfolio management and prosecution, IP diligence, and competitive landscape assessments. Gargi has been practicing for over 15 years, after receiving her JD from the University of Chicago and her PhD in Neuroscience from Stanford.
