This session will cover updates on patent damages, including addressing apportionment issues related to both lost profits and reasonable royalties. The presentation will also comment on the import of patent pools and the applicability of precedential case law, such as Georgia-Pacific and Fromson, given the changing landscape in determining damages based upon a reasonable royalty approach.

John Hansen
John Hansen is a Vice President and founding member of TM Financial Forensics working out of the San Francisco office. John is a Certified Public Accountant licensed in the State of California, Certified in Financial Forensics and is a Certified Licensing Professional with over 20 years of consulting experience. He focuses on commercial damages and intellectual property valuation, licensing and infringement damages. John has analyzed and addressed claims for lost profits, price erosion, reasonable royalties, unjust enrichment, increased costs and diminution of asset and business value in a variety of circumstances and industries. He has testified as an expert on damages and economic issues in deposition, trial and arbitration in State Courts, Federal Courts and in the International Trade Commission. He has also presented to various universities and industry groups addressing financial issues, accounting, damages and intellectual property valuation.
Jim Pampinella is a Managing Director in the Disputes and Investigations practice of Navigant Consulting in San Francisco and is a national expert on complex commercial litigation matters, specializing in intellectual property strategic consulting and disputes. Jim has testified as an expert on damages issues in deposition, trial (Federal and State court) and arbitrations and has presented at mediations. He has more than 20 years of consulting experience and also serves on the planning committees of the Advanced Patent Law Institute and the Intellectual Property Institute held by the Berkeley Center for Law & Technology/Stanford Law School and the University of Southern California Gould School of Law, respectively. Jim, a Certified Public Accountant in the State of California, has experience in a wide variety of industries including computer hardware and software components, life sciences, aerospace, hospitality, publishing and consumer products.
