Patent Practice – Staying Cool When Ethics Issues Heat Up: Are you “that lawyer” – the one who enjoys patent matters because of their complexity? The multiple layers of complexity include the relationships between individuals and corporations, the technologies involved, the different legal doctrines and standards applied in the PTO and the courts, and the global complexity of IP protection. And, with each new layer, different ethics issues can heat up. This seminar focuses on recent cases in District Courts and the PTO regarding ethics and professional responsibility including: duty of loyalty (conflicts and disqualification); duty of candor; confidential information in IP cases; duty to supervise; 2013 revisions to the USPTO Code of Professional Conduct and recent USPTO enforcement.

Michelle GallowayMichelle Greer Galloway is of counsel to the Cooley Litigation department and teaches at Stanford and Santa Clara law schools.

Ms. Galloway’s technology litigation practice focuses on patent litigation and strategic counseling. Ms. Galloway also advises clients on legal, strategic and technical issues of information management, including electronically stored information, and compliance with a variety of litigation, regulatory and jurisdictional areas. She serves on the Advisory Board of the Georgetown University Law Center’s Advanced E-Discovery Institute and is a member of The Sedona Conference Working Group on Electronic Document Retention and Production. She is a contributing editor of The Sedona Conference® Primer on Social Media (2012). Ms. Galloway also advises clients in the area of risk management, compliance, and ethics. She serves as Chair of the ABA Intellectual Property Section, Ethics and Professional Responsibility Committee and Chairs the ABA Task Force regarding USPTO proposed disciplinary rule changes. In 2013, she was awarded the ABA IPL Recognition of Outstanding Leadership Contribution.
